If the raid of the Gaza Freedom Flotilla was a disaster for the Israel Defense Forces, its aftermath demonstrated an equally bewildering performance by the Israeli media. The IDF Spokesman’s Office churned out one misleading claim after another, each one more implausible than the next, seeking to implant in the public’s mind a version of events that bore little relation to reality. To a degree, this was to be expected; but it was startling to see how some of Israel’s most respected reporters lined up to serve as military stenographers, barely challenging the IDF’s rapidly changing versions of events. IDF claims about the flotilla passengers’ links to Al Qaida, anti-Semitic statements shouted at the Israeli Navy, and their terrorist intentions were eagerly broadcast by the Israeli media without a second thought. When independent reporters forced the IDF to retract or “clarify” all of these claims, Israeli news outlets refused to correct their errors, or covered them up without acknowledgment.

At the top of Israel’s political and military systems stand two men, Ehud Barak and Benjamin Netanyahu, who are behind the brutal attack on the Gaza flotilla that shocked the world but that seemed to be hailed as a pure act of self-defence by the Israeli public.

Although they come from the left (Defence minister Barak from the Labour Party) and the right (Prime Minister Netanyahu from Likkud) of Israeli politics, their thinking on Gaza in general and on the flotilla in particular is informed by the same history and identical worldview.

I have, of course, been outraged at armed men boarding ships in international waters, killing passengers on board who attempt to resist and then forcing their ship to the hijackers’ home port. I am, of course, talking about the Somali pirates who are preying on Western ships in the Indian Ocean. How dare those terrorists dare to touch our unarmed vessels on the high seas? And how right we are to have our warships there to prevent such terrorist acts.

But whoops! At least the Israelis have not demanded ransom. They just want to get journalists to win the propaganda war for them. Scarcely had the week begun when Israel’s warrior “commandos” stormed a Turkish boat bringing aid to Gaza and shot nine of the passengers dead. Yet by week’s end, the protesters had become “armed peace activists”, vicious anti-Semites “professing pacifism, seething with hate, pounding away at another human being with a metal pole”. I liked the last bit. The fact that the person being beaten was apparently shooting another human being with a rifle didn’t quite get into this weird version of reality.

Los Angeles Times, May 31, 2010

About 10,000 Turkish demonstrators marched from Israel’s Consulate in Istanbul toward the city’s main square Monday after Israeli forces killed at least 10 pro-Palestinian activists and wounded dozens aboard a Gaza-bound flotilla.

The protesters earlier Monday tried storm the Consulate building but were blocked by police. They set Israeli flags on fire as television stations broadcast the protest live.

In Jordan, hundreds demonstrated in the capital, Amman, to protest the Israeli action and demand that their government breaks diplomatic relations with the Jewish state.

The Israeli ambassadors in Sweden, Spain, Denmark and Greece were summoned for meetings, and the French foreign minister called for an investigation. Activists from all of those European countries were on board the flotilla.

Besides swift, angry reaction from the Palestinians, strong condemnation came from the United Nations and the European Union.

Greece suspended a military exercise with Israel, and the Arab League called an emergency meeting.

The United Nations expressed “shock” and condemned the killings.

“We are in contact with the Israeli authorities to express our deep concern and to seek a full explanation,” said a statement from the highest-ranking U.N. official in the region, Robert Serry.

Palestinian President Mahmoud Abbas condemned the Israeli “aggression,” declared three days of mourning across the West Bank and called on the U.N. Security Council and Arab League to hold emergency sessions on the incident

“What Israel has committed on board the Freedom Flotilla was a massacre,” Abbas was quoted as saying by the official Wafa news agency.

Ismail Haniyeh, leader of the rival Hamas government in Gaza, condemned the “brutal” Israeli attack and called on U.N. Secretary-General Ban Ki-moon to intervene.

Iranian president Mahmoud Ahmadinejad, already a harsh critic of Israel, called the military action “inhuman.”

A spokesperson for Catherine Ashton, EU foreign policy chief said the official “expresses her deep regret at the news of loss of life and violence and extends her sympathies to families of the dead and wounded. On behalf of the European Union she demands a full inquiry about the circumstances in which this happened. … She calls for an immediate, sustained and unconditional opening of the crossing for the flow of humanitarian aid, commercial goods and persons to and from Gaza.”

“The Israeli people must choose: either the fulfillment of Palestinian national and human rights or a continuation of international condemnation, marginalization and boycott against Israel.” So said Palestinian grassroots activist Jamal Juma’, Coordinator of the Stop the Wall Campaign at a press conference today (10 February 2010) about Israel’s escalating campaign against Palestinian grassroots and international solidarity activists. Convened at the offices of the Alternative Information Center (AIC) in Jerusalem, the press conference was conducted jointly by Stop the Wall and the International Solidarity Movement.

Juma’, who was recently released from Israeli prison following a one month detention for which charges were never filed, detailed Israel’s serious escalation in attacks against Palestinian grassroots activist since the beginning of 2010: over 40 activists have already been detained since 1 January, about half of whom are children. “This is not disconnected from Israel’s other occupation policies in the West Bank and East Jerusalem,” noted Juma’. “The ethnic cleansing in Jerusalem, where against 15,000 Palestinian homes Israel has issued demolition orders. The almost nightly raids by the Israeli military in so-called Area A.”

In response to the question of why Israel is targeting civil society activists now, Juma’ said that “Israel wants to silence the voices of Palestinians and international solidarity activists. It mistakenly believes that by attempting to destroy Palestinian civil movements, that the Palestinian people will accept Israeli political conditions. However, more and more villages are joining the popular resistance movement as a result of the Israeli crackdowns.”

Juma’ further added that the Palestinian Authority must decide “what it wants. In order to begin negotiations, the PA should demand a total freeze on settlement construction and an international guarantee that any future agreement will actually be implemented, unlike the Oslo Accords and the Road Map. Juma’ believes the PA still hopes that international pressure will influence the current Israeli government, but added that “the PA will be embarrassed as this will not happen.”

Also speaking at the press conference were international solidarity activists Bridgette Chappell and Ariadna Jove Marti of the International Solidarity Movement (ISM). Chappell and Jove were illegally detained by the Israeli army in Ramallah and released on bail earlier this week.

“We are not breaking any laws and are standing in solidarity with Palestinians in a non-violent and legal way,” said Chappell. “The ISM media office in Ramallah was raided by the Israeli military last night at 3am, which was the second raid this week,” added Chappell. “The Israeli army clearly has no regard for the Oslo Accords and Area A, which is under full Palestinian control. These raids and arrests are meant to intimidate and harass us, to stop us from bearing witness to the Israeli human rights violations that help perpetuate the occupation,” stated Chappell. “However, it won’t work.”

Chappell and Jove believe their pending case before the Israeli Supreme Court will take 3-4 weeks, while they are also appealing in the Jerusalem District Court against the ruling that they are not allowed into the West Bank.

Attending the press conference were representatives from the Spanish and French consulates. Jove praised the support she has received to date from the Spanish Embassy and Consulate, while Chappell reflected that assistance from the Australian Embassy has brought up questions concerning Australia’s close relations with Israel.

The following statement was issued on 3 October 2010 by 14 leading Palestinian human rights organisations regarding the Palestinian leadership’s decision to delay discussion of the Goldstone report to the UN Human Rights Council investigating the Israeli attacks on Gaza in December 2009-March 2010.

On 2 October 2009, the Palestinian leadership – under heavy international pressure lead by the United States – deferred the draft proposal at the Human Rights Council endorsing all the recommendations of the UN Fact Finding Mission (the Goldstone Report). This deferral denies the Palestinian peoples’ right to an effective judicial remedy and the equal protection of the law. It represents the triumph of politics over human rights. It is an insult to all victims and a rejection of their rights.

The crimes documented in the report of the UN Fact Finding Mission represent the most serious violations of international law; Justice Goldstone concluded that there was evidence to indicate that crimes against humanity may have been committed in the Gaza Strip. Violations of international law continue to this day, inter alia, through the continuing Israeli-imposed illegal blockade of the Gaza Strip. The findings of the Mission confirmed earlier investigations conducted by independent Palestinian, Israeli and international organizations.

The injustice that has now been brought upon Palestinians has been brought upon everyone on this globe. International human rights and humanitarian law are not subject to discrimination, they are not dependent on nationality, religion, or political affiliation. International human rights and humanitarian law apply universally to all human beings.

The rule of law is intended to protect individuals, to guarantee their fundamental rights. Yet, if the rule of law is to be respected it must be enforced. World history, and the Israeli occupation of Palestinian land has shown us that as long as impunity persists, the law will continue to be violated; innocent civilians will continue to suffer the horrific consequences.

Justice delayed is justice denied. All victims have a legitimate right to an effective judicial remedy, and the equal protection of the law. These rights are universal: they are not subject to political considerations. In the nine months since Operation Cast Lead, no effective judicial investigations have been conducted into the conflict. Impunity prevails. In such situations, international law demands recourse to international judicial mechanisms. Victims’ rights must be upheld. Those responsible must be held to account.

The belief that accountability and the rule of law can be brushed aside in the pursuit of peace is misguided. History has taught us time and time again, that sustainable peace can only be built on human rights, on justice, and the rule of law. For many years in Palestine international law, and the rule of law, has been sacrificed in the name of politics, and cast aside in favor of the peace process. This approach has been tried, and it has failed: the occupation has been solidified, illegal settlements have continued to expand, the right to self determination has been denied; innocent civilians suffer the horrific consequences. It is now time to pursue justice, and a peace built on a foundation of human rights, dignity, and the rule of law. In Justice Goldstone’s words, there is no peace without justice.

The justifications given by the Palestinian leadership regarding the decision to defer are inappropriate. Consensus is not required, the United Nations system works on a majority basis. Since the beginning of the UN, and over the course of the Israeli occupation begun in 1967, consensus has rarely been acquired. The UN was established to represent the will of the nations of the world; it is inevitable that there will be dissent and disagreement. Decisions must rest on the will of the majority.

As human rights organizations we strongly condemn the Palestinian leaderships’ decision to defer the proposal endorsing all the recommendations of the Fact Finding Mission, and the pressure exerted by certain members of the international community. Such pressure is in conflict with States international obligations, and is an insult to the Palestinian people.

As human rights and civil society organizations concerned with rights and justice, we declare that we will double our efforts to seek justice for the victims of the violations of human rights and international law in Palestine without delay.
